Class Action Consulting Services

With experience dating back to the first MDL litigation of the 1970s, we have helped clients administer settlements involving billions of dollars and hundreds of millions of class members. Simply put, Analytics is a class action consulting firm that understands what it’s really about: a timely, accurate, and cost-effective settlement process.

Our success is based on our unparalleled service and steadfast dedication to our clients. From expert opinions regarding the structure of settlements to ensuring that class members receive plain-language information regarding the litigation and claims, our experts provide superior value every step of the way.

Our consulting services include:

Pre-Settlement Consulting

Pre-settlement, we work closely with our clients to prepare detailed project plans and guidelines that address all aspects of the proposed settlement. These plans ensure that the scope of the work is clearly identified, appropriate responsibilities are assigned, and realistic timelines are established for key settlement milestones. We also aim to identify and resolve any potential issues that could lead to delays and additional costs when providing notice and distributing settlement funds.

Analytics’ planning includes:

  • Setting Notice and Claim Timelines
  • Establishing Data Processing and Analysis Guidelines
  • Development of Notice Plan, as Required
  • Development of Claims Processing Guidelines

Data Analysis and Consulting

We offer complete data analysis, from raw data files to distribution. Our experts provide guidance in deposing defendants regarding computer systems and perform all necessary data analysis and standardization. By doing the work ourselves (as opposed to outsourcing it to a third party), we can control the quality and safety of critical data and guarantee the widest practicable distribution of the class notice. In one recent engagement, for instance, Analytics analyzed more than 100 million transactions from multiple defendants and legacy computer systems to identify class members and develop a plan of allocation.

Legal Notification

The consequences of incomplete or insufficient notice can be far-reaching and expensive.   At Analytics, our experts design notice plans that use plain language to reach class members. Our notice plans also provide quantifiable measures of adequacy and fulfill all CAFA requirements.

Services offered include:

  • Notice Drafting  Our notices are written in clear and concise plain language to capture the attention of class members (and satisfy the plain language amendment to Rule 23). Following the “illustrative” model notices prepared by the Federal Judicial center, we work in unison with all parties to accurately convey case details in an unbiased manner so that those affected can make an informed decision about their rights and options.
  • Notice Dissemination  When class members are known, individual notification is generally best. Our mailing protocols are designed to achieve a high delivery rate to save time, minimize expenses, and ensure success. Whenever possible, claim forms are preprinted with class members’ names and addresses, along with relevant transaction information, to facilitate claims processing, improve accuracy, and help class members file complete claims.

Legal Notice Expert Testimony

When the identities of class members are not known, a media-based or combined mailing/media notice program may be necessary. With backgrounds in media planning and buying, our experts have designed and implemented many of the largest notification programs in recent history. Our in-depth analysis of key factors, such as target audience demographics and media usage, geographic scope (zip-code specific to worldwide), timing constraints, and monetary parameters, allow us to design programs that specifically meet each case’s unique needs. Our media-based notice programs are scientifically calculated to effectively reach class members with the “best notice practicable,” providing courts with the information they need to make an informed decision as to the adequacy of the program.

Complete Claims Processing

Since MDL 10 in the 1970s, Analytics has been a leader in developing claims processing methods and procedures and providing clients with high-quality, cost-effective solutions. From settlements involving fewer than 100 class members to engagements requiring analysis of more than 100 million records, Analytics has the resources and knowledge necessary to facilitate the claims process and ensure that each class member receives the full amount to which he or she is entitled.

Advanced Controls, Audits, and Reviews

We process every claim completely, allowing our systems to identify the potential value of deficient claims, model the effects of changing claim criteria, and streamline the deficient claim process for class members. Our complete claims processing also minimizes those unfortunate situations where class members are asked to correct a deficient claim, only to be told later that they will receive nothing from the settlement fund.

Our systems and controls have been audited, tested, and accredited to ensure that all data regarding class members and claimants are protected from inappropriate use or release. We provide the highest standard of care in protecting the confidentiality of the information we collect for each settlement. In fact, our standards are high enough that the Federal agencies responsible for enforcing data privacy laws are counted among our clients.

Disbursements and Tax Reporting

Analytics efficiently manages all aspects of distribution for a wide range of settlement benefits.

Services offered include:

  • Controlled disbursement
  • Cash management
  • Investment management
  • Escrow services
  • Tax reporting (1099, 1098, and W-2)
  • Qualified Settlement Fund tax reporting

For nearly four decades, our clients have trusted Analytics to help with their class action and mass tort settlement distributions. We go to great lengths to protect the confidentiality of the data entrusted to us by our clients, ensure the integrity of the settlement administration process, and protect the rights of class members.

Our internal controls are designed to exceed both regulatory standards and industry practices. These controls — together with our quality assurance and security measures — ensure the efficient, accurate, and cost-effective distribution of settlement benefits, including checks, coupons, vouchers, and products.

Additionally, we manage escrow and IRS compliance issues on behalf of our clients. To enforce strict financial controls and minimize the possibility of fraud, Analytics’s check distribution processes are based upon “best payment practices” as outlined by a consensus of treasury management professionals.
